Article 1 – Definitions

In these Terms and Conditions the following definitions apply:

Cooling-off period: the period within which the consumer can exercise their right of withdrawal.

Consumer: the natural person who does not act in the course of a profession or business and enters into a distance agreement with the entrepreneur.

Day: calendar day.

Long-term transaction: a distance agreement relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.

Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a a way that allows future consultation and unchanged reproduction.

Right of withdrawal: the possibility for the consumer to withdraw from the distance agreement within the cooling-off period.

Entrepreneur: the natural or legal person offering products and/or services remotely to consumers.

Distance agreement: an agreement whereby, within the framework of an organized system for distance selling of products and/or services, exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the agreement.

Means of distance communication: any means that can be used to conclude an agreement without the consumer and entrepreneur being in the same place at the same time.

Terms and Conditions: the present Terms and Conditions of the entrepreneur.

Article 3 – Applicability

These Terms and Conditions apply to every offer made by the entrepreneur and to every distance agreement concluded between the entrepreneur and the consumer.

Before the distance agreement is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated that the Terms and Conditions can be inspected at the entrepreneur’s premises and will be sent free of charge upon request.

If the distance agreement is concluded electronically, the text of these Terms and Conditions may be made available electronically in such a way that it can be easily stored by the consumer on a durable data carrier.

If specific product or service conditions apply in addition to these Terms and Conditions, the consumer may always rely on the provision most favorable to them in the event of conflicting conditions.

If one or more provisions in these Terms and Conditions are invalid or annulled, the remaining provisions remain in force.

Situations not covered by these Terms and Conditions must be interpreted in accordance with the spirit of these Terms and Conditions.


Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

The offer is non-binding. The entrepreneur is entitled to modify or adjust the offer.

The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow proper evaluation by the consumer.

Images used are a truthful representation of the products. However, the entrepreneur cannot guarantee that displayed colors correspond exactly with the actual product colors.

All images, specifications, and data in the offer are indicative and cannot give rise to compensation or termination of the agreement.

Each offer contains information about:

- the price of the product (excluding customs clearance costs and import VAT where applicable)

- shipping costs

- how the agreement will be concluded

- whether the right of withdrawal applies

- the method of payment, delivery, and execution of the agreement

- the period for accepting the offer

- possible communication costs

- whether the agreement will be archived and how it can be accessed

- how the consumer can correct provided information

- available languages of the agreement

- applicable codes of conduct

- the minimum duration of the agreement in the case of long-term transactions


Article 5 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set.

If the agreement is concluded electronically, the entrepreneur will confirm receipt electronically.

The entrepreneur will take appropriate technical and organizational measures to secure electronic data transfer.

The entrepreneur may investigate whether the consumer can fulfill payment obligations and may refuse an order based on reasonable grounds.

The entrepreneur will provide the consumer with the following information in writing or via durable data carrier:

1. the business address where complaints can be submitted

2. conditions and procedures for exercising the right of withdrawal

3. information about guarantees and after-sales service

4. the information described in Article 4

5. requirements for terminating agreements longer than one year

Each agreement is concluded under the condition of sufficient product availability.


Article 6 – Right of Withdrawal

When purchasing products, consumers have the right to withdraw from the agreement within 30 days without giving any reason.

This cooling-off period starts on the day after the product has been received by the consumer.

During the cooling-off period, the consumer must handle the product and packaging with care.

If the consumer exercises the right of withdrawal, the product must be returned with all accessories and, if reasonably possible, in its original condition and packaging.

The consumer must notify the entrepreneur within 30 days via written notice or email.

After notification, the product must be returned within 30 days.

If the consumer fails to notify the withdrawal or return the product within the specified periods, the purchase becomes final.


Article 7 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, return shipping costs are the responsibility of the consumer.

If the consumer has paid an amount, the entrepreneur will refund this amount within 30 days, provided the returned product has been received or proof of shipment has been provided.


Article 8 – Exclusion of the Right of Withdrawal

The entrepreneur may exclude the right of withdrawal for products:

- made according to consumer specifications

- clearly personal in nature

- that cannot be returned due to their nature

- that deteriorate quickly

- whose price is subject to financial market fluctuations

- newspapers and magazines

- audio/video recordings where seals are broken

- hygienic products where seals are broken


Article 9 – The Price

Prices will not increase during the validity period stated in the offer unless due to changes in VAT rates.

Products whose prices depend on financial market fluctuations may have variable prices.

Price increases within 3 months after concluding the agreement are only allowed if due to legal regulations.

All prices are subject to typographical and printing errors.


Article 10 – Conformity and Warranty

The entrepreneur guarantees that products comply with the agreement and meet reasonable standards of quality and usability.

Defects or incorrect deliveries must be reported within 30 days after delivery.

Warranty does not apply if:

- products are repaired or modified by the consumer or third parties

- products are used improperly

- damage results from incorrect handling


Article 11 – Delivery and Execution

The entrepreneur will take the greatest possible care when receiving and executing orders.

Orders will be executed within 30 days, unless a longer delivery period has been agreed.

If delivery is delayed or an order cannot be fulfilled, the consumer will be informed within 30 days.

If delivery becomes impossible, a replacement product may be offered.

The risk of damage or loss remains with the entrepreneur until delivery to the consumer.


Article 12 – Long-term Transactions: Duration, Termination and Renewal

Consumers may terminate agreements for an indefinite period at any time with a notice period of at most one month.

Fixed-term agreements may be terminated at the end of the contract period.

Automatic renewal is not allowed unless consumers can terminate the renewed agreement with a notice period of one month.


Article 13 – Payment

Unless otherwise agreed, payments must be made within 7 working days after the cooling-off period begins.

Consumers must report inaccuracies in payment details immediately.

In the event of non-payment, the entrepreneur may charge reasonable costs.


Article 14 – Complaints Procedure

Complaints must be submitted within 7 days after the consumer discovers the issue.

Complaints will be answered within 14 days.

If a complaint cannot be resolved mutually, it becomes a dispute subject to dispute resolution procedures.


Article 15 – Disputes

All agreements between the entrepreneur and the consumer are governed exclusively by Dutch law, even if the consumer resides abroad.
